Distillery Files Civil Suit Against Shipping Company Over Alleged $300,000 ‘Cyber Hijack’ Tequila Heist

Daytoon Distributors has filed a civil lawsuit against a pair of shipping and logistics companies over an alleged tequila heist that the company says lost it $325,000 in product. The incident reportedly occurred in December, when the North Carolina-based distiller ordered 16 pallets of its new Hacienda Chactun Tequila from Mexico. At some point along the way, the shipment was allegedly hacked, disappearing 19,000 bottles of unreleased spirits. According to the brand's CEO, the criminals sent fake traffic updates (including photos of a flat tire) to postpone discovery of the theft. The exact details of the heist are still unclear, though Daytoon owner Mark Milliken termed it a "sophisticated cyber hijack."
“We’ve poured our hearts and souls into crafting this exceptional liquor,” Geoffrey Losee, outside counsel for Daytoon said at the time. “Now, thanks to these digital Scrooges, our launch has been thrown into disarray.”
On Friday, Daytoon filed a civil suit against Tazmanian Freight Forwarding Inc. and Landstar Express America for damages exceeding $75,000. In its request for a jury trial, the brand claims that Tazmanian had been hired as the sole carrier between Mexico and North Carolina. According to the lawsuit, however, Tazmanian only carried the shipment to Loredo, Texas. Without notifying Daytoon, the company hired Landstar — from which the tequila was stolen — for the remaining leg of the journey. When the crime was first reported, officials traced the last known location of the shipment to Rancho Cucamonga, California. Los Angeles Police eventually tracked down the tequila to a warehouse in Fontana, where several of the bottles had reportedly been opened. The thieves have yet to be identified.
“The original trailer was discovered during a sting operation,” Daytoon owner Mark Bloomquist told Port City Daily. “Half of the load was impounded and ultimately destroyed. Due to that fact, the chain of custody had been broken.”
Despite the heist, Daytoon has since released its Blanco and Reposado tequila expressions in the American market. In addition to agave spirits, the brand is best known for its Blue Shark Vodka, Summer Storm Moonshine and Stede's Caribbean Rum. [botmc-promo]
